New legislation on cannabis legalization in Germany: What does this mean for home cultivation and the purchase of seeds?
On July 1st, partial legalization of cannabis will come into force in Germany, which will affect home cultivation and the purchase of seeds. In addition to joining cannabis clubs, there is also the option to privately grow up to three female cannabis plants. This arrangement offers an alternative for those who do not wish to become a member of a club.
Interestingly, both club members and non-members can purchase seeds or cuttings to grow in a cannabis club. This measure is intended to facilitate access to cannabis for personal consumption without promoting the black market.
However, it is important to note that the harvested cannabis products may only be used for personal consumption. Selling, passing on to third parties or giving away to friends or roommates is prohibited by law. Violations of this regulation can be punished with a prison sentence of up to three years or a fine.
Cannabis clubs as a legal source of weed: what are the rules and how does it work?
Purchasing grass outside the model regions is only possible through so-called cannabis clubs or “cannabis social clubs” with up to 500 members. In addition to private cultivation, these clubs are the only legal source of cannabis in Germany after partial legalization.
Cannabis club membership allows members to receive up to 50 grams of cannabis per month, with a limit of 30 grams for those between the ages of 18 and 21. The THC content of the cannabis obtained may be a maximum of ten percent. The cultivation is financed through membership fees, although there is no sale in the traditional sense.
Penalties for the black market and import of cannabis from the Netherlands
Cannabis trafficking remains a criminal offense on the black market, although some penalties have been increased to strengthen youth protection. People who sell cannabis to minors now risk a prison sentence of at least two years.
It is still forbidden to buy cannabis from the Netherlands for personal consumption and import it into Germany. However, the import of cannabis seeds from the EU for cultivation for personal consumption or for cultivation clubs is permitted.
The new cannabis legalization laws in Germany are intended to both make it easier to access cannabis for personal consumption and curb the black market. It remains to be seen how these measures will affect the consumption and distribution of cannabis in Germany in the long term.
